Gone are the days when divorce has to be a courtroom affair. Many couples now find ways to divorce with grace and to maintain a civil relationship with their former spouse. Amicable divorce is clearly better for children than being caught between their fighting parents.


Mediation is a conflict resolution tool that can be applied to many situations, including divorce. A mediator can be a social worker, a psychologist or an attorney who is trained in mediation. If a divorcing couple agrees to use mediation to reach an agreement, the third party mediator meets together with the couple. The mediator’s goal is to enable the couple to reach an agreement—if this is accomplished, the agreement may become binding by the court. If they are unable to do so, the couple will have to proceed with litigation.

A couple that is divorcing is likely to have some areas of conflict during the process.
